The Petitioner No.1 is a registered and recognized trade Union of cabin crew employees of the Air India Limited. Petitioner Nos.2 to 13 are the employees of Air India Ltd., and the members of Petitioner No.1 Union. The above Petition is filed by the Petitioners impugning a communication dated 18th November, 2021 issued by Air India. The same pertains to cross fleet training from B-777 to A-320 commencing from 22nd November, 2021. According to the Petitioners, the said communication pertaining to cross fleet training is arbitrary, discriminatory, unjust and also illegal. Admittedly, the communication is dated 18th November, 2021. The Petitioners have approached this Court one month thereafter i.e. on 17th December, 2021.

The learned Senior Advocate representing Air India states that the training of 7 batches of cabin crew employees has already commenced since August, 2021 which includes Petitioner No.7.

In view of the above, the question of granting any urgent ad-interim reliefs to the Petitioners, without giving an opportunity to Air India to file its Affidavit in Reply, does not arise. Air India shall file its Affidavit in Reply within a period of one week from today.

Stand over to 4th January, 2022.

All steps taken by Air India in the meantime, shall be subject to the further orders passed by this Court on the adjourned date. All contentions of the parties are kept open.
