Judgment
Surya Kant, J.—This Criminal Writ Petition in substance contains allegations of illegal detention of the petitioner''s associates - co-villagers as bonded labourers by respondents No. 5 to 7.
On November 11, 2011, the Warrant Officer was appointed to visit the brick-kiln and report with regard to the allegations.
The Warrant Officer has submitted his report dated 14.11.2011 reporting that he along with the police party took a round of the premises having no fence or boundary wall and found that all the alleged detenues were roaming freely and were not found being guarded by anyone at that time and that there was no situation like illegal detention of labourer. The report further explained that a telephone call was received on the mobile phone of the Warrant Officer informing him that the labourers have been kidnapped by the owner of the brick-kiln in Haryana near UP border. The caller was advised to approach the nearest police station.
From the contents of the report no prima facie case of illegal detention is made out.
Dismissed.
