The writ petitioners by way of the connected writ application are seeking directions to set aside and quash the Notifications dated 6th December 2022, 11th January 2023 and 17th January 2023, whereby the process of elections for the office of the Syiem of Mylliem had been announced by the District Council respondents, and by this Misc. case are seeking stay of the abovementioned orders.
Mr. J.Shylla, learned counsel for the petitioners submits that the writ petitioners who are eligible to contest for the said post, were unaware and totally in the dark about the said Notifications, whereby elections were announced. As such, he submits that their valuable right to contest has been deprived. He therefore, prays that in the interim, the Notification dated 17th
Mr. V.G.K.Kynta, learned Special counsel assisted by Mr. H.Wanshong, learned counsel for the respondent Nos. 1 & 2 submits that the electoral process is already underway and the petitioners have not shown any substantial ground to warrant any interference from this Court and if any order is passed, the same will derail the entire process.
After thoughtful consideration of the interim order sought for by the writ petitioners and on perusing the materials as placed, no grounds have been made out that will warrant any interference at this stage, especially considering the fact that the voting has been fixed on the 20th February, 2023 and the locus of the petitioners is yet to be established.
Accordingly, interim prayer is rejected. Misc. application stands closed and disposed of.
