Judgment
Manmohan Sarin, J.—Rule.
With the consent of the parties, writ petition is taken up for disposal.
Petitioner has filed this writ petition, seeking re-evaluation of answer sheet and award of the marks, as per the grades awarded. Petitioner also seeks internal assessment in Science subject to be made for him.
The main plank of the petitioner''s submission is that petitioner had been awarded 66 per cent marks in Science subject i.e. Physics, Chemistry and Biology. Petitioner claimed that he had been awarded C,B and B grads. The grading system of the Board was claimed to be as under:-
Grade Marks A 89-100 B 79-89 C 69-79 D 35-69 Based on the submission that the petitioner had got grades C, B and B, it apparently appeared to the Court that awarding of 66 per cent marks was obviously an error. Petitioner would get 75 per cent marks, even if the minimum of each grade was to be taken.
Counter affidavit has since then been filed. The factual situation is stated to be totally different. The grading system is as under:

From the foregoing, it would be seen that based on the grading, C,B and B, petitioner could get 66 per cent marks. As a matter of fact, petitioner has been awarded 55 marks in Physics, 68 in Chemistry and 69 in Biology. These would make an average of around 64 per cent. Petitioner had been given the benefit of 1 marks in Biology and the same had been taken as 70.
It would be seen that petitioner''s apprehension of having been awarded wrong marks not in conformity with grade is totally misplaced and wrong.
The writ petition has no merit and is dismissed.
