Petitioner has filed this bail cancellation application under Section 439(2) Cr.P.C.

F.I.R. No 522/2015 was registered at Police Station Bajaj Nagar, Jaipur for offence under Sections 420, 406, 467, 468, 471 I.P.C.

It is contended by counsel for the petitioner that respondent No.2 has not appeared before the Investigating Officer and has changed his residence

and has not co-operated with the investigation.

Learned Public Prosecutor and counsel for the accused respondents have opposed the bail cancellation application. Their contention is that

repondent has appeared before the Investigating Officer. Prior to the acceptance of bail under Section 438 Cr.P.C. and thereafter also he had

submitted bail bonds before the Investigating Officer.

It is also contended that respondent has not violated any terms and conditions and proper course available to the petitioner is to approach the

concerned Court which has granted the bail application.

Considering the contentions put forth by counsel for the State, I am not inclined to allow the bail cancellation application.

This bail cancellation application is, accordingly, rejected.
