Judgment
In Re : CRAN 2179 of 2020
Petitioners undertake to affirm and stamp the petition/application as per Rules within 48 hours of resumption of normal functioning of the court. Subject to such undertaking, the application is taken up for hearing through video conferencing.
Heard the learned advocates appearing for both the parties.
It is submitted on behalf of the petitioners that no narcotic substance was recovered from the possession of the petitioner no.2.
Learned advocate appearing for the State opposes the prayer for bail and submits that he has no instruction with regard to the involvement of petitioner no.2 herein.
He seeks time to produce the case diary.
We have considered the materials on record. There is ample material disclosing involvement of petitioner no.1 in the alleged trafficking of narcotic substance above commercial quantity. Accordingly, we are not inclined in granting bail to petitioner no.1.
However, in view of the submission that no narcotic substance was recovered from petitioner no.2, we are inclined in granting interim bail to him subject to production of case diary.
Accordingly, the accused/petitioner no.2, namely Intaj @ Entaj Mondal, be released on interim bail upon furnishing a bond of Rs.10,000/- (Rupees Ten thousand only), with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, Barasat, North 24-Parganas subject to condition that the said petitioner shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever or commit similar offences in future. The interim bail shall continue for three months or until further orders, whichever is earlier.
In the event he fails to appear before the trial court without justifiable cause, the trial court shall be at liberty to cancel his bail automatically without reference to this court.
Let this matter appear under the same heading two months hence. Case diary be produced on that day.
The application being CRAN 2179 of 2020 is accordingly, disposed of.
