The petitioners claiming themselves to be the President/ Secretary of the Association and whether it is a recognized or not, is not the question for this court to examine and their complaint is that there are certain person who are working in excess of the cadre strength and that deserves interference of this court.

A comparative statement of staff position as on 01.01.2016 (Annex.6) is on record and the total working officers on deputation are three i.e. one-Managing Director & two-General Manager. Counsel submits that there is only one post sanctioned of General Manager but two are working on deputation.

It is true that this has been indicated in the staff position (Annex.6) as well the post of General Manager is to be filled by deputation and not amongst the Bank officials and normally the Officer should not work in excess of the sanctioned strength but sometimes it become inevitable but that may not permit the Association to question unless rights of members of the Association are being infringed or violate the mandate of Art.14 of the Constitution which is not the case pleaded by the petitioners.

Consequently, the instant writ petition being devoid of merit, accordingly stands dismissed.
