Akhileshwar Singh Roy vs The Emperor

This rule was granted to show cause why certain orders referred to in the petition of the Petitioner should not be set aside as they were not warranted by law. At the time of issuing the rule the Court directed that the Sub-Divisional Magistrate be called upon to submit an explanation in respect to the matters referred to in the petition and affidavit of the Petitioner upon which the rule was granted. The Sub-Divisional Magistrate apparently has left the District but an explanation has been submitted to us by the Magistrate of the district. We have considered the matters set forth in that explanation and we are unable to see any justification for the orders in question. We, therefore, make the rule absolute and set aside the orders.
