Judgment
Harnaresh Singh Gill, J
Case is taken up for hearing through video conferencing.
This is the petition under Section 439 of Cr.P.C. for grant of regular bail in case FIR No.118 dated 01.10.2020 registered under Sections 386, 387, 506
of Indian Penal Code, 1860 at Police Station Sadar, Panipat.
Reply by way of affidavit of Deputy Superintendent of Police, Crime Against Women, Panipat, filed through e-mail is taken on record.
Learned counsel for the petitioner states that even as per the statement of the co-accused Vikas, the grandfather of the petitioner-Khushi Ram is
working with the complainant for the last more than 20 years and moreover the alleged black pen has been recovered from the main accused-Vikas.
He further submits that the petitioner has been in custody since 04.10.2020. Moreover the report of the Forensic Science Laboratory is still awaited.
Learned State counsel assisted by the learned counsel for the complainant has stated that it is not only one letter which has been written by the
accused but three different letters were written. Challan has been presented and charges has been framed and the case is now fixed for defence
evidence.
I have heard the learned counsel for the parties.
The petitioner has been in custody since 04.10.2020. Trial of the case would take time to conclude. Therefore, no useful purpose would be served by
keeping the petitioner behind the bars.
In view of the above, without commenting anything on the merits, lest it should prejudice the case of either side, the present petition is allowed and the
petitioner is ordered to be released on bail on his furnishing bail and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate.
