Judgment
Vipin Sanghi, CJ
1) In terms of our order dated 14.07.2022, the respondent’s committee has examined the mark-sheets provided by the petitioners to the respondents.
2) Mr. Joshi has tendered a report in Court of the meetings held by the committee on 28.07.2022 and 29.07.2022, to examine the mark-sheets provided by the petitioners. As per the said report the mark-sheets of all the petitioners were found in order, and they have been permitted to participate in the mains examination, except petitioner Nos. 15, 56 and 66, as the said petitioners did not provide their mark-sheets for examination by the committee. Mr. Joshi submits that the result in respect of the petitioners, who have been cleared, i.e., the petitioners, except petitioner Nos. 15, 56 and 66, has also been declared on 01.08.2022.
3) Mr. Mainali submits that the present case is covered by the judgment rendered by us on 02.08.2022, in Writ Petition (S/B) No. 434 of 2022.
4) From the report tendered by Mr. Joshi, it appears that the Expert Committee has also proceeded on the same basis, as decided by us in our aforesaid judgment. The three petitioners, whose cases have not been cleared, are those who have not provided their mark-sheets.
5) We, therefore, dispose of this petition by granting petitioner Nos. 15, 56 and 66, two weeks time from today to provide their mark-sheets to the respondents. In case, the mark-sheets are provided, the same should be examined by the Members of the committee. They may hold meeting by circulation, in case, they do not find it convenient to meet physically to examine the documents that may be submitted by the said petitioners, and to declare - whether the said petitioners are eligible or not, for offering their candidature for the post of Horticulture Development Officer. In case the said petitioners do not provide their mark-sheets, they shall not be entitled to any relief.
6) The writ petition stands disposed of accordingly.
