The present Writ Petition has been filed under Article 226 of the Constitution of India with the following prayers:-

“(A) Issue a writ, order or direction in the nature of certiorari for quashing the order dated is 11th of June 2024 passed by the Registrar of the respondent no. 1 university qua the petitioner, whereby, the petitioner has been debarred from both the semesters of 3rd year of B.Sc (Honours) Agriculture course. (Annexure No. 1 to this writ petition).

(B) Issue a writ, order or direction in the nature of mandamus must be issued directing the respondents to permit the petitioner to continue with the 4 years B.Sc (Honours), Agriculture course from the respondent university.

(C) Issue any suitable writ, order or direction which this Hon'ble Court may deem fit and proper under the facts and circumstances of the case.

(D) Award costs of the petition to the petitioner.”

Heard Mr. Sandeep Kothari, learned counsel for the petitioner and Mr. Shubhang Dobhal, learned counsel for the respondents.

As per the submissions of learned counsel for both the parties, the present matter is covered by the judgment dated 02.11.2023, passed by the Co-ordinate Bench of this Court in Writ Petition (M/S) No.1612 of 2023, “Dipesh Phulera Vs. G.B. Pant University of Agriculture and Technology, Pantnagar, District Udham Singh Nagar and Others” and Writ Petition (M/S) No.1650 of 2023, “Himanshu Raj Vs. G.B. Pant University and Others”.

With the consent of both the parties, the present Writ Petition (WPMS No.1716 of 2024) is disposed of in terms of the judgment dated 02.11.2023, passed in Writ Petition (M/S) No.1612 of 2023, “Dipesh Phulera Vs. G.B. Pant University of Agriculture and Technology, Pantnagar, District Udham Singh Nagar and Others” and Writ Petition (M/S) No.1650 of 2023, “Himanshu Raj Vs. G.B. Pant University and Others”.
