Judgment
Antony Dominic, J.—The petitioner was one among the 629 applicants to the one vacancy of General Manager in the District Co-operative Bank, Thiruvananthapuram, for which a notification was issued by the first respondent. The applicants were short listed and finally a list of 11 were prepared by the 1st respondent and the selection was conducted on the basis of an interview. It is challenging this process the Writ Petition was filed mainly challenging the method of short list adopted by the PSC. The learned Single Judge upheld the action of the PSC and it is therefore this appeal is filed impugned in the judgment.
We heard the learned counsel for the appellant and the learned Standing Counsel for respondents 1, 2, 3 and 5.
Although all the submissions made before the learned Single Judge were reiterated before us, we do not find any relevance to those submissions because in the counter affidavit filed by the PSC, in paragraph 6 it has been stated thus:-
6....But the experience of the petitioner as Marketing Manager in Milco cannot be considered as the one required for the post for which selection is conducted. Hence his application was rejected as he was not in possession of the qualification of experience as prescribed in the Gazette Notification for the post. Rejection Memo was issued to the petitioner on 01.02.2011.
There is no reply affidavit filed by the appellant disputing the above averment.
Evidently therefore, the application of the appellant was rejected by the PSC on the ground that he was not possessing the prescribed experience. This was intimated to him by a memo on 01/02/2011. This therefore shows that his candidature was not accepted by the PSC and the rejection of his candidature was not challenged by the appellant. In such a situation, the appellant being not a candidature for the selection to the post of General Manager, cannot challenge the short listing process adopted by the PSC, which also, in our view, has been rightly upheld by the learned Single Judge.
Hence, the Writ Appeal is dismissed.
