The present writ petition has been preferred against the order dated 18.03.2019, whereby the respondent No.4 has refused to award bonus marks to the petitioner for her experience of working as Shiksha Mitra under Sarv Shiksha Abhiyan.

Present petitioner, having experience of working as Shiksha Mitra under Sarv Shiksha Abhiyan, filled his application form for the post of Lower Division Clerk(LDC) pursuant to advertisement dated 22.03.2013, while enclosing the experience certificate of having worked under the above referred scheme.

The recruitment process remained stalled due to litigation. When the same was taken up by the respondents, the petitioner was informed that since his experience certificate is not countersigned, he is not eligible for bonus marks.

As such petitioner moved a representation dated 13.03.2019 and requested respondent No.4 to countersign the experience certificate, which request was turned down, inter alia stating that his experience as Shiksha Mitra is not eligible for bonus marks.

Challenging the order dated 18.03.2019, Ms. Aruna Negi, learned counsel for the petitioner contended that in light of the circular dated 26.05.2017, issued by the State Government, the petitioner having worked under Sarv Shiksha Abhiyan is entitled for bonus marks. She added that respondent No.4 has erred in refusing to countersign the experience certificate issued in petitioner's favour and thus depriving him of the bonus marks.

Inviting Court's attention towards para No.11 of the circular dated 26.05.2017, learned counsel argued that all the persons having worked under Sarv Shiksha Abhiyan or NRHM are entitled to bonus marks and prayed that a direction be issued to respondent No.4 to countersign the experience certificate and award bonus marks.

Mr. Piyush Bhandari, learned counsel for the respondents submitted that true it is, that the persons having worked under Sarv Shiksha Abhiyan or NRHM have been held to be entitled for bonus marks, but such entitlement is based upon the nature of duties performed by such persons.

He argued that the petitioner having worked as Shiksha Mitra cannot claim bonus marks, while applying for the post of Lower Division Clerk(LDC), as the nature of duties performed by the petitioner are not akin to that of a Lower Division Clerk(LDC).

Learned counsel submitted that as per para No.11 of the advertisement, the persons having worked on specified positions under the specified schemes of the Government alone are entitled for bonus marks.

Para No.11 of the advertisement reads thus:-

(अ) शैक्षणिक योग्यता एवं अनुग्रह अंक :-

आवेदक का चयन सीनियर सैकेण्डरी परीक्षा में प्राप्तांक प्रतिशत तथा पूर्व में कार्यरत कार्मिकों को प्राप्त होने वाले अनुग्रह अंकों के योग के आधार पर किया जावेगा। राजस्थान पंचायती राज नियम 1996 के संशोधित प्रावधानों के अनुसार मनरेगा अथवा ग्रामीण विकास और पंचायती राज विभाग की किसी योजना में कार्यक्रम अधिकारी/सहायक कार्यक्रम अधिकारी, वरिष्ठ तकनीकी सहायक, प्रोग्रामर, सहायक लेखाधिकारी, कनिष्ठ तकनीकी सहायक, कनिष्ठ अभियन्ता, ग्राम रोजगार सहायक, डाटा एन्ट्री ऑपरेटर, लेखा सहायक, कनिष्ठ लिपिक, समन्वयक आई ई सी, समन्वयक प्रशिक्षण, कोर्डिनेटर सुपरविजन तथा कम्प्यूटर आपरेटर विथ मशीन (नियोजन अभिकरण के माध्यम से लगे हुओ के सिवाय) पद अथवा समन्वित जल ग्रहण प्रबन्धन कार्यक्रम /राष्ट्रीय जल ग्रहण विकास कार्यक्रम / डी.डी.पी. / डी.पी.ए.पी. के अन्तर्गत जल ग्रहण विकास दल के अभियान्त्रिकी, कृषि, पशुपालन या समाज विज्ञानी सदस्य अथवा निर्मल भारत अभियान (सम्पूर्ण स्वच्छता कार्यøम) के अन्तर्गत जिला समन्वयक स्वच्छता/ ैॅैभ्म्, ब्लाक कोर्डिनेटर/ल ेखाकार या कम्प्यूटर/एम.आई.एस. असिसटेंट के पद पर अनुग्रह अंक प्रदान किये जा सकेंगे। उपरोक्त वर्णित किसी भी कार्मिक को एक वर्ष से कम अवधि के अनुभव पर किसी प्रकार का अनुग्रह अंक अनुज्ञात नहीं होगा। नियम 273 राजस्थान पंचायती राज नियम 1996 के प्रावधानों के अनुसार अभ्यर्थी द्वारा सीनियर सैकेण्डरी परीक्षा में प्राप्तांकों को 70 प्रतिशत वेटेज दिया जावेगा। तद्नुसार प्राप्त प्रतिशत (दशमलव के तीन अंकों सहित) में निम्नानुसार अनुग्रह अंक जोड़े जाकर अभ्यर्थियों की मैरिट निर्धारित की जायेगी :-

Learned counsel for the respondents pointed out that the petitioner had worked as 'Shiksha Mitra' under Sarv Shiksha Abhiyan, which position does not fall under the nature of work prescribed under para No. 11 of the advertisement, hence, the petitioner is not entitled for bonus marks and get his experience certificate countersigned for the purpose of claiming bonus marks for the post of LDC.

Indisputably, petitioner has worked as Shiksha Mitra under Sarva Shiksha Abhiyan, a scheme duly floated by the State of Rajasthan and recognized for the purpose of selection on the post aforesaid. However, while ascertaining as to whether petitioner is entitled for bonus marks or not, more important question, required to be gone into is: whether the duties performed by a candidate are covered by para No.11 of the advertisement or not.

The petitioner has worked as Shiksha Mitra, whose duties are essentially to help in imparting education. Position of Shiksha Mitra is neither covered by para No.11 of the advertisement aforesaid nor is the responsibilities/duties performed by the Shiksha Mitra are akin to the duties performed by the persons holding the posts enshrined under such para.

There is no material to suggest that petitioner has performed duties as has been performed by the persons, who have been held entitled to bonus marks for the post of LDC.

As an upshot of the discussion aforesaid, this Court is of the firm opinion that the petitioner having worked as Shiksha Mitra is not entitled for bonus marks. The respondents have committed no error in rejecting his request for countersignature and turning down the claim for bonus marks.

The writ petition is dismissed.
