Judgment
Heard Mr. C. S. Sinha, learned counsel appearing for the petitioner as well as Mr. S. Deb, learned counsel appearing for the respondents.
The petitioner who was working as the Dean (Research and Academics) in the respondent- University Academy in terms and conditions of the contract, as available in the communication under No.Appt/HR/IUT/15/4182 dated 17.06.2015.
It is apparent from the said communication that the tenure was settled till 30.06.2016. It has been noted that the tenure of the employment may be extended on expiry, subject to the satisfactory performance.
The respondents by their communication dated 12.04.2017, Annexure-2 to the writ petition, has apprised the petitioner as follows:
"We wish to inform that the contract of your employment had expired on June 30, 2016. The Management has decided to relieve you of the duties at the close of office hours on April 14, 2017."
The said communication is evidently made in terms of the clause-18 of the said communication, Annexure-1 to the writ petition. Clause-18 provides that the contract will automatically come to an end on completion of the fixed terms as per the conditions of appointment, unless the management decides to extend the same.
The said decision of the management is reflected in the communication dated 12.04.2017 and that has been questioned by the petitioner by filing this writ petition. According to the petitioner, as represented by Mr. C. S. Sinha, learned counsel that principles of the natural justice was not observed. Moreover, the action is grossly arbitrary and as such interference is warranted from this court.
Mr. Deb, learned counsel appearing for the respondents has submitted that the petitioner has been relieved of his duties as the term had expired. The petitioner does not inhere any right to be afforded with further opportunity.
Having regard to the submission made by the learned counsel for the petitioner, this court does not find any merit in the writ petition.
Accordingly, the same is dismissed.
There shall be no order as to costs.
