Judgment
Learned Counsel for the Appellants and Respondent are present. Learned Counsel for the Appellants is directed to serve a Soft-Copy of the Appeal to the Liquidator-Respondent No. 1.
Learned Counsel for the Appellants submits that he has filed instant Appeal under Section 61(1) of the Insolvency and Bankruptcy Code, 2016 (IBC in short) against the Orders dated 17/05/2021 and 04/08/2021 passed in I.A. No. 1248/ND/2020 and I.A. No. 3341/ND/2021 in IB-475/(ND)/2018 by National Company Law Tribunal, New Delhi, Court-IV whereby and where under Order dated 17.05.2021 the Appellant herein held guilty under Section 68 of IBC and directed to pay fine of Rs. Two Lakhs within two weeks in the account of the Corporate Debtor. Further the Order dated 04.08.2021 passed in I.A. 3342/ND/2021 the Liquidator was directed to file the complaint in terms of provisions of Section 340 of Cr. P.C.
Learned Counsel for Respondent No. 1 is directed to file hard-copy of Reply-Affidavit within two weeks. Rejoinder, if any, may be filed within a week, thereafter.
The operation of the Impugned Orders dated 17/05/2021 and 04/08/2021 in I.A. No. 1248/ND/2020 and I.A. No. 3341/ND/2021 in IB475/(ND)/2018, respectively shall remain stayed.
Ms. Pooja Dhar, Advocate appears on behalf of Corporate Creditor and she is directed to file Application (hard-copy) proposing to intervene in this matter within two weeks.
