Judgment
By this Petition, fled under Article 226 of the Constitution of India, the Petitioner is seeking quashing of FIR dated 13th May, 2019 in CR No. 72 of
2019 at Chandwad Police Station under Sections 354(D), 435, 500 of the Indian Penal Code read with Section 66(D) of the Information Technology
Act, 2000 fled at the instance of Respondent No.2, who is father of the victim.
After the matter is heard for some time, the learned Mugdha 1 of 3 2 28-WP 2012-21.odt counsel for the Petitioner submits that she had fled her
consent affdavit in this Court, however neither the soft copy nor the hard copy of the affdavit of the Victim is before the Court.
When this Court inquired with the counsel for the Petitioner as to disclosing the name of the victim or her family, she seeks leave to amend the
Petition, so as to protect the identity of the victim and her family.
In this view of the matter, list the matter on 15/06/2021, so as to enable the Petitioner to amend the Petition, and also to furnish a copy of the
consent affdavit to this Court.
The victim is present before this Court through video conferencing and has been identifed by her Advocate Mr. Ghule. Upon enquiry, she has
expressed her desire that the said FIR may be quashed so as to move on further in life and requests that her presence be dispensed with on the next
date as she is from remote place and in the family way. Accordingly her presence on the next date may be Ajay Sahebrao Aher vs The State Of
Maharashtra And Anr on 1 June, 2021
