This assessee’s appeal for Assessment Year 2012-13 arises against the C IT(A)/NFAC, De lhi’ s DIN & order No. ITBA/NFAC/S/250/2025-26/1080135440(1) dated 28.08.2025, in proceed ings u/s 144 of the Income Tax Act, 1 961 (in short “the Act”).

2.

Heard both the p arties at length. Case file perused.

3.

It transpires during the course of hearing that both the learned lower authorities have treated the assessee’s cash deposits in the relevant previous year amounting to Rs.26,11,500/- as unexplained; in assessment order dated 13.11.2019 as upheld in the lower appellate discussion.

4.

That being the case, the assesse e appears to have filed his cash flow statement pertaining to the relevant previous year between 0 1.04.2011 to 02.03.2012 inter alia revealing cash in hand of Rs.2,30,000/- as we ll as cash withdrawals amounting to Rs.13,63,000/- which co uld indeed be prima facie inferred as the source of cash deposits although not reconciled and verified in both the lower proceedings.

5.

Be that as it may, it is deemed appropriate in these peculiar facts that a lump sum addition of Rs.2,50,000/- only in the assessee’s hands would be just and proper in the given facts with a rider that the same shall not be treated as a precedent. Necessary computation shall follow as p er law.

6.

No other ground or argument has been pressed.

7.

This assessee’s appeal is partly allowed.
