Judgment
Sabina, J.—Petitioner has filed this petition seeking a writ in the nature of certiorari for quashing the order dated 26.2.2014 (Annexure P-7) whereby petitioner had been ordered to be transferred from his place of posting under respondent No. 3 to National Fertilizers Limited Unit Bathinda.
Learned counsel for the petitioner has submitted that petitioner was working as a Senior Assistant Manager with National Fertilizers Limited Naya Nangal Unit and had been transferred to Bathinda Unit as he had filed CWP No. 25947 of 2013 seeking his promotion.
Learned counsel for the respondents, on the other hand, has submitted that the transfer order had been passed in routine. Various other persons had also been transferred as was evident from Annexure R-2.
Impugned order dated 26.2.2014 (Annexure P-7) reads as under:-
Shri Ajay Kumar Sharma, Sr. Asstt. Manager (Mech.), E. No. 0301/03006 is hereby transferred from Nangal Unit to NFL, Bathinda Unit on his existing pay and scale of pay with immediate effect, on administrative considerations.
He will be entitled to usual transfer TA/Joining time, as per rules of the company.
Other terms and conditions of his appointment shall remain unchanged.
A perusal of the above order reveals that petitioner has been transferred merely on administrative considerations. A perusal of Annexure R-2 reveals that some other officials have also been transferred to different units on administrative grounds as well as on the request of the concerned official. Annexure R-1 is the transfer policy of N.F.L. and as per the same, all employees of the company are transferable. In case of administrative exigencies of company''s work, employees can be transferred irrespective of the period of service rendered by an employee at a particular station. It is the case of the respondents that they had received the summons in CWP No. 25947 of 2013 on 14.12.2013 whereas transfer order (Annexure P-7) was passed on 26.2.2014. From 3.12.2013 to 10.3.2014, 43 transfers were made. A perusal of Annexure R-2 further reveals that number of transfers were made in February 2014. In these circumstances, it appears that the plea taken by the petitioner that the transfer order had been passed merely because he had filed the writ petition seeking promotion, is without any basis.
No ground for interference by this Court is made out.
Dismissed.
