Judgment
I.A. No. 2485 of 2023:
This application has been filed praying for following reliefs:
“A. RELIEF SOUGHT:
In the interest of natural justice, it is most respectfully prayed that this Hon'ble Appellate Tribunal be pleased to:
(i) Allow the present Application thereby passing appropriate directions to the Respondent IRP restricting the IRP from exercising any power and/or resort to any act beyond “Fernhill Project”; and
(ii) Pass an order thereby allowing the current board of directors of the M/s Ansal Properties and Infrastructure Ltd. to continue to exercise their powers for day to day functioning/operations of M/s Ansal Properties and Infrastructure Ltd. with respect to all the other projects except "Fernhill Project" without interference/intervention of the Respondent IRP; and any
(iii) Pass any other interim relief as this Hon'ble Appellate Tribunal deems fit and proper in the facts and circumstances of the instant case.”
In Para 8 of the application itself it is mentioned that an application being I.A. No. 498 of 2023 was filed before the Adjudicating Authority, on which order was passed on 24.01.2023.
The order passed by the Adjudicating Authority on 24.01.2023 fully covers the prayers made in the application. We see no reason to entertain this application. Application I.A. No. 2485 of 2023 is dismissed.
