Notice. Mr. Anil Jaswal, learned Additional Advocate General, appears and waives service of notice on behalf of respondents No.1 to 5.
CWP No.715 of 2018, titled Raj Kumar Mehta Versus State of H.P. & Ors., was disposed of by a Division Bench of this Court vide judgment
dated 27.11.2019, operative part whereof is as under:-
“4. In view of the instructions placed on record by the learned Additional Advocate General, we direct the State to carry out tender proceedings in
accordance with law and take the same to its logical conclusion by awarding work to the successful bidder within a reasonable period, but not later
than one year so that the construction work of the Ayurvedic Health Sub Centre gets started and the public gets benefited out of the same. However,
before carrying out construction work of Health Sub Centre, the concerned revenue authorities are directed to carry out demarcation in respect of
Khasra No.820/281 as well as adjoining Khasra No.267 to ensure that no construction is carried out on the adjoining Khasra number, which has not
been donated for construction of Ayurvedic Health Sub Centre.â€
The allegation levelled in the instant contempt petition is that the respondents without carrying out the demarcation, as directed in the afore-
extracted para of the judgment, are carrying out the construction work at the site.
In the aforesaid circumstances, this contempt petition is disposed of by directing respondent No.1 to implement the judgment in letter and spirit
within a period of two weeks from today and report compliance to this Court on 9th September, 2020. Pending miscellaneous application(s), if any,
also stand disposed of.
Authenticated copy be supplied to learned counsel for the parties by the Secretary.
