Judgment
Learned counsel for respondent Nos.3 and 4 raised preliminary objection regarding maintainability of this petition by contending that petitioner was an employee of a private unaided educational institution and, therefore, writ petition is not maintainable.
Learned counsel for the petitioner by placing reliance on an order passed by this Court in W.P. No.108/2017 (Dr. Pushkar Gupta vs. State of M.P.) dated 31.01.2017 urged that the petition is maintainable.
No other point is pressed by the learned counsel for the parties.
I have heard the parties at length and perused the record.
In the case of Dr. Pushkar Gupta (supra) this Court considered catena of judgments of Supreme Court and after following the ratio decidendi of the judgment of Apex Court in Ramesh Ahluwalia vs. State of Punjab & Ors. (2012) 12 SCC 331 and Janet Jeyapaul vs. SRM University & Ors. (2015) 16 SCC 530 opined that petition is indeed maintainable.
Considering the aforesaid, the objection raised by learned counsel for respondent Nos.3 and 4 is overruled.
Learned counsel for respondent Nos.3 and 4 prays for and is granted 15 days time as a last chance to file reply on merits.
List the matter on 30.03.2020.
