R.C. Deepak, J.—Heard learned Counsel for the accusedappellant, learned AGA and perused the record.

Learned Counsel for the accusedappellant submits that the name of the accusedappellant does not find place in the missing report of the deceased. There is no evidence that the accusedappellant participated in the commission of the murder of the deceased Raghvendra Kumar Srivastava. The accusedappellant was on bail during trial and he has not misused the privileges granted to him. There is no possibility that the appeal be heard in the near future.

Considering the arguments of the learned Counsel for the parties, the appeal is admitted.

Appellant Ajay Kumar convicted under Sections 147, 149, 302 IPC in S.T. No. 1274 of 1999, P.S. Kotwali, District Allahabad shall be released on bail on his furnishing a personal bond of Rs. 25,000 with two sureties each in the like amount to the satisfaction of Court concerned.

The realization of fine shall also remain stayed during the pendency of his appeal before this Hon''ble Court.
