This revision has been filed under section 58(1)(b) of The Consumer Protection Act, 2019 in challenge to the impugned Order dated 11.12.2023 passed by the State Commission in Appeal No. 1950 of 2023 arising out of Order dated 21.10.2023 passed by the District Commission in complaint no. 92 of 2013.
It appears form the perusal of the record that this petition has been filed against the concurrent Orders passed by the two Fora below. The District Commission had disposed of the complaint by directing the allotment of a different plot to the complainant as the initially allotted plot was allegedly a disputed one. The appeal was filed on behalf of the petitioner / opposite party but the State Commission did not find any good reason to interfere in the Order passed by the District Commission. Therefore, the present petition now has been filed.
Heard learned counsel for the petitioner at length and the record has been perused. During the course of the arguments, learned counsel took a brief interlude and submitted, on instructions, that the petitioner does not want to pursue the petition any further and may be permitted to withdraw the same and requested that issues involved in the matter may be kept open and the matter may not be treated as precedent.
In the wake of the above submissions made, the present stands dismissed as withdrawn. It may be observed that as the merits of the case have not been adjudicated the matter shall not be treated as a precedent and the issues involved in the matter, if any are kept open.
The Registry is requested to send a copy each of this Order to the parties in the petition and to the learned counsel within three days as well as to the fora below. The stenographer is requested to upload this Order on the website of this Commission within three days.
