Judgment
This matter is taken up through Hybrid hearing.
Sh. R.K. Sinha, Counsel for the respondent stated that he has filed reply to the appeal in pursuance of the order dated 23.06.2026 passed by this Tribunal. Sh. Sinha, Counsel further stated that as per the defendant no.7 was served with entire set of OA to his previous Counsel vide email dated 19.02.2021. The copy of email dated 19.02.2021 is also placed on record.
Sh. Anand Aggarwal, Counsel for the appellant (defendant no.7) stated that in the impugned order itself the date is mentioned as 16.08.2024 (actual date is 16.07.2024) as admitted by Counsels for the parties. However, Sh. Anand Aggarwal also stated that till today the respondent has not supplied the complete set of paper book and also referred the order dated 31.08.2021.
The perusal of order dated 31.08.2021 reflects that the Counsel for the appellant i.e. defendant no.7 has made a submission regarding non supply of complete copy of OA paper book and has requested for supply of another copy.
There is appearing to be a dispute regarding actual date of service of OA with the appellant i.e. defendant no.7. In these circumstances, the appellant is directed to file fresh application for filing written on behalf of appellant/defendant no.7 before the DRT-III, Delhi within 7 days from today. Reply thereto, if any, be filed thereafter within 7 days. The copy shall be exchanged between the respective Counsels. The DRT-III, Delhi after completion of pleadings pertaining to the said application decide the said application if so file within a period of maximum two weeks to avoid unnecessary delay of O.A. bearing T.A. No. 353/2022. The appeal is accordingly disposed of.
The copy of this order be sent to DRT-III, Delhi for information and compliance.
