Application for pre-arrest bail.
This application is filed by the accused in S.T.No.458/2019 of the Additional Chief Judicial Magistrate Court, Thrissur.
It is revealed from the records that she has not appeared before the court below and hence, warrant has been issued against her. Thereafter the court has proceeded against the petitioner under Sections 82 and 83 of the code of Criminal Procedure.
Now the petitioner has filed this application with a request 'not to arrest' her in this case. The records would reveal that the case has been pending against her right from 2019 on wards and she never appeared before the court below and so the proceedings have been initiated by the learned Judicial Magistrate. An order to nullify the proceedings initiated by a court of competent jurisdiction can not be granted by this court by allowing this application for pre-arrest bail.
Accordingly, this bail application stands dismissed. The petitioner shall surrender before the court below and seek regular bail.
Dismissed.
