ORDER
02.09.2022: It is brought to the fore that the ‘Liquidation Order’ in respect of the ‘Corporate Debtor’ was passed by the ‘Adjudicating Authority’ (National Company Law Tribunal, Division Bench – I, Chennai) in IA/361/CHE/2022 in IBA/140/2020 (Filed under Section 33 (2) of the Insolvency & Bankruptcy Code, 2016) on 28.04.2022 and therein the ‘Adjudicating Authority’ (National Company Law Tribunal, Division Bench – I, Chennai) had ordered for ‘Liquidation’ of the Corporate Debtor. This fact is not disputed on behalf of the ‘Appellant’ and the Learned Counsel appearing for the Respondent No.1.
In view of the fact that the ‘Liquidation Order’, in respect of the Corporate Debtor was passed by the ‘Adjudicating Authority’ (National Company Law Tribunal, Division Bench – I, Chennai) on 28.04.2022 in IA/361/CHE/2022 in IBA/140/2020, the Learned Counsel appearing for the ‘Appellant’ seeks ‘permission’ from this ‘Appellate Tribunal’ to withdraw the instant Comp App No.322/2022. Acceding to his said request, the instant Comp App No.322/2022 is ‘dismissed’ as ‘withdrawn’. No Costs. The connected IA No.681/2022 is Closed.
