Since common questions of facts and law are involved in these petitions, they are decided by this common judgment.

Petitioners were appointed on various posts on different dates in a Project named “Sarva Shiksha Abhiyanâ€. They were to be paid fixed salary

with admissible dearness allowance and other allowances. It is the grievance of the petitioners that despite Government Orders, they are not paid

dearness allowance and others allowances.

Heard learned counsel for the parties and perused the record.

Learned counsel for the petitioners would submit that a similar controversy was decided by this Court in WPSS No. 1535 of 2012, Subhash Singh &

others v. Secretary Education, Govt. of Uttarakhand & others (for short, “the Writ Petitionâ€), on 10.06.2013. The judgment passed in the Writ

Petition on 10.06.2013 was challenged by the State in Special Appeal No. 352 of 2013, State of Uttarakhand and others v. Subhash Singh & others,

which was dismissed on 06.12.2016. It is further case of the petitioners that the State challenged the order dated 06.12.2016 passed in Special Appeal

No. 352 of 2013, in Special Leave to Appeal (C) No. 14944 of 2014, which was also dismissed. Therefore, it is argued that the instant case is squarely

covered by the judgment of this Court passed in the Writ Petition.

Learned State Counsel admits the legal position that the instant case is squarely covered by the judgment of this Court passed in WPSS No. 1635 of

2012, Subhash Singh & others v. Secretary Education, Govt. of Uttarakhand & others, dated 10.06.2013.

In view of the above, this Court is of the view that since the case is squarely covered by the judgment passed in the Writ Petition, these writ

petitions may also be decided accordingly.

All the writ petitions stand disposed of in terms of the judgment dated 10.06.2013 passed by this Court in Writ Petition (S/S) No. 1535 of 2012,

Subhash Singh & others v. Secretary Education, Govt. of Uttarakhand and others.
