I.A. No.1/2022:
The matter comes up for consideration of an application seeking modification of the order dated 01.07.2019.
While arguing the application, learned counsel for the petitioners contended that in spite of the fact that though this Court had directed the trial Court to conclude the suit proceedings with utmost promptitude within a period of six months, but the learned trial Court has not decided the same even after expiry of three years of the order aforesaid.
After hearing learned counsel for the petitioners and going through the contents of the application, this Court is of the considered view that the prayer made in the application does not fall within the scope of modification of the order passed by this Court on 01.07.2019. The petitioners cannot challenge the subsequent action/decision in the guise of instant application or in the name of modification.
The misc. application is, therefore, dismissed.
The petitioners will be free to take their remedies in accordance with law.
