When this matter is taken up for consideration today, it is submitted by the learned Standing counsel appearing for the respondent bank that the Securitisation Application challenging the sale proceedings (proposed to be held on 28.06.2022) along with the stay application are listed for consideration before the Tribunal tomorrow (28.06.2022).
Having regard to the aforesaid submission of the learned Standing Counsel for the bank and taking note of the contentions taken by the learned counsel appearing for the petitioner, I dispose of the writ petition directing that the confirmation of the sale of the petitioner's property (if it fructifies) on 28.06.2022 shall stand deferred for a period of five days from today. I make it clear that I have not expressed any opinion on the merits of the matter and the Tribunal may decide the matter in accordance with law. However, if the Tribunal decides not to grant any interim reliefs in the Securitization Application, the bank will be free to proceed the matter in accordance with law.
