Mr. J. Sai Deepak, learned Senior Counsel for the respondent points out that this appeal cannot be maintainable under Section 13 of the Commercial Courts Act, 2015 read with Order XLIII of the CPC.

Ms. Suruchi Aggarwal, learned Senior Counsel for the appellant on instructions seeks leave to withdraw the appeal, in order to avail appropriate remedies available in law.

Leave and liberty as aforesaid is granted.
