Judgment
Sudhir Narain, J.—This appeal has been filed against order dated 23101998 granting Rs. 25,000/ as interim compensation under Section 140 of the Motor Vehicles Act.
I have heard Shri Kuldip Shanker Amist, learned counsel for the appellant. It is submitted that the appellant is not liable to pay the amount as the compensation is being claimed on account of injury caused to Master Raju while he was sitting in another truck. The Motor Accident Claims Tribunal (in short as Tribunal) has considered this aspect of the matter. It is an interim award. I do not find any legal infirmity.
The appeal is accordingly dismissed.
However, as stated that the appellant has already deposited Rs. 12,500/and further Rs. 12,500/ is yet to be deposited which shall be deposited by the appellant with the Tribunal. The amount of Rs. 12,500/ can be withdrawn by the claimant without furnishing any security and rest of Rs. 12,500/ can be withdrawn on furnishing security to the satisfaction of the Tribunal concerned. Appeal dismissed.
