Judgment

As per the application for grant of bail, this is the first application filed under Section 439 Cr.P.C on behalf of the applicant.
Applicant is in custody since 6.8.2022 in connection with Crime No.393/2022 registered at Police Station Jhansi Road, Gwalior for the offences punishable under Section 392 of IPC and Section 11, 13 of the MPDVPK Act.
Ms. Rukshana Bano Shah, wife of the petitioner is in tears because of her helplessness as her advocate has not appeared. She prays for indulgence in the matter of grant of bail to the applicant Abid Shah.
Neither Government Advocate is present nor case diary is available from concerned Police Station. It is indeed a most unfortunate state of affairs and individual's personal liberty is seriously jeopardised in the obtaining facts and circumstances. Hence, in the fitness of things, it is considered expedient to order for production of case diary by the SHO Police Station Jhansi Road, Gwalior on the next date of hearing. Failure of compliance of this order shall be viewed seriously.
Let copy of this order be sent to SHO, Police Station, Jhansi road, Gwalior as well as S.P. Gwalior for compliance.
