The instant Criminal Appeal has been filed against the judgment dated 29.03.2023, passed by learned Special Judge (N.D.P.S.)/ IInd Additional Sessions Judge, Dehradun in Special Sessions Trial No. 132 of 2013, “State of Uttarakhand vs. Abhishek Rana”, by which, the appellant- accused has been convicted and sentenced to undergo rigorous imprisonment for a period of two years along with a fine of Rs. 10,000/- for the offence under Section 8 read with Section 21 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard Mr. Pawan Mishra, learned counsel for the appellant and Mr. Atul Sah, learned Deputy Advocate General for the State.

Heard on the Bail Application (IA No.1 of 2023).

Mr. Pawan Mishra, Advocate, submitted that there are substantial doubts about the conviction. Appellant was on bail during the trial and he is on interim bail. Appellant has deposited the fine, as imposed by learned Trial Court.

Learned counsel for the State opposed the bail application.

Considering the facts and circumstances of the case, this Court is inclined to grant bail to the appellant, namely, Abhishek Rana, provided he submits his personal bond and two reliable sureties, each in the like amount to the satisfaction of the court concerned.

Bail Application is allowed accordingly.
