It is submitted by Learned Senior Counsel for the Petitioner that a sum of ₹ 3,46,500/- (Rupees three lakhs, forty six thousand and five hundred) only, was due as rent, payable to the Petitioner, by the Respondent from May, 2018 to September, 2024. However, the entirety of the amount has not been paid in terms of the Order dated 08-12-2023, of another Bench of this Court, passed in RFA No.06 of 2023 (Mohammed Safique vs. Abhishek Rai).

Learned Counsel for the Respondent submits that a misunderstanding has occurred on the part of the Respondent concerning the Order of the Learned Court. It is further submitted that ₹ 4,000/- (Rupees four thousand) only, per month, payable as rent dues, was however deposited by the Respondent, erroneously, instead of ₹ 4,500/- (Rupees four thousand and five hundred) only, per month. That, there is a shortfall of ₹ 500/- (Rupees five hundred) only, per month, for the period stated hereinabove. He seeks three months’ time to take steps in this context.
