Petitioners herein seek quashing of FIR No. 255/2022 dated 09.03.2022, registered at Police Station Burari, for commission of offences under Sections 354D, 341, 509, 506, 34 IPC, along with all consequential proceedings arising therefrom, on the basis of compromise arrived at between the parties.

The abovesaid FIR was registered on the basis of a complaint made by respondent No.2.

Both the petitioner herein, who are real brothers, were her tenants in the same building and as per the averments made in the FIR, they passed obscene and degrading comments upon her. In her such complaint, she claimed that besides such remarks, she was harassed, intimidated and threatened and, therefore, facing a great deal of harassment from them, she was forced to report the matter to police.

Charge-sheet against both the petitioners has already been filed.

Quashing is being sought because of the fact that the parties have been able to settle their differences.

MoU dated 25.11.2022 is on record.

As per the abovesaid MoU, besides respondent No.2 herein, her brother Arvind has also entered into settlement and the settlement is with respect to both the petitioners herein as well as the parents of petitioners.

Respondent No.2 has joined the proceedings through video-conferencing and has been duly identified by the Investigating Officer, who is present in Court.

Respondent No.2 submits that she has already shifted to Pune and has entered into the abovesaid settlement, voluntarily, and without any coercion and influence from any corner whatsoever. It is submitted that there was one more case between the parties. Such other case was registered as FIR No.1083/2021, PS Burari, North, Delhi for offences under Section 354/509/34 IPC and the abovesaid case has been registered on the basis of the complaint made by the mother of the petitioners. Respondent No.2 submits that the abovesaid case has already been quashed. A copy of such order dated 28.07.2025 has been shown during the course of proceedings. The same is taken on record.

During course of the arguments, both the petitioners have, again, tendered apology to respondent No.2, which has been accepted by her. She submits that she would have no objection if the present FIR is quashed.

In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is, primarily, private in nature. In any case, even the complainant does not wish to press any charges against the petitioners.

Accordingly, exercising inherent powers vested in this Court under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, it is deemed appropriate to quash the instant FIR.

Consequently, to secure the ends of justice, FIR No. 255/2022 dated 09.03.2022, registered at Police Station Burari, for commission of offences under Sections 354D, 341, 509, 506, 34 IPC, along with all consequential proceedings arising therefrom, is, hereby, quashed.

Original affidavits and Settlement of the parties, copies of which have been placed on record in the present proceedings, shall be submitted before the learned Trial Court within four weeks from today, so that these become part of Trial Court Record.

The petition stands disposed of in aforesaid terms.
