Judgment

Mr. Bhattacharjee, learned Counsel, appears in support of the writ petition and submits that by the impugned order dated 8th November, 2019 issued by the East Kolkata Wetlands Management Authority (for short EKWMA), the hoardings of the petitioner at Mouza- Dhapa, JL. No.2 under P.S. Pragati Maidan were directed to be demolished.
Mr. Bhattacharjee submits that such order of demolition is against the principles of natural justice and also contrary to the provision of EKWMA Act, 2006.
Mr. Bandapadhyay, learned Counsel, appears for the EKWMA and submits that the petitioner has not raised the points now being raised at the hearing, before the EKWMA in the first place. It is therefore submitted that the petitioner has raised fresh points now before Court without giving the EKWMA an opportunity to deal with them.
Having heard the parties and considering the materials placed, the EKWMA deserves the opportunity to re-visit the order dated 8th November, 2019 upon receiving a complete and comprehensive representation from the writ petitioner.
Till the order is revisited within a period of two weeks from the date of actual receipt of the comprehensive representation from the writ petitioner, the petitioner shall be protected from coercive action.
In view of the admitted stand on merits taken by the petitioner, Prayer 'c' of the writ petition is not worthy of being entertained.
WP 23751(W) of 2019 stands accordingly disposed of.
