Judgment

Apprehending arrest in Crime No. 445 of 2024 of Mavelikkara Police Station, Alappuzha District, registered for offences punishable under Section 427 r/w 34 of the IPC and Section 3 of the Prevention of Damage to Public Property Act, 1984 and Section 140 of the Electricity Act, 2003, the petitioner/fourth accused has filed this petition seeking anticipatory bail.
The allegation against the petitioner is that he along with other accused destroyed the electric line and service wire belonging to the Kerala State Electricity Board. It is alleged that it happened during the transportation of a statue for a temple festival.
The learned counsel appearing for the petitioner and the learned Public Prosecutor were heard.
Taking note of the allegations raised against the petitioner and the fact that an amount of Rs.90,000/- has already been deposited by the other accused as a condition for obtaining bail, I am inclined to grant pre-arrest bail to the petitioner, more so when no other antecedents were reported against the petitioner. It is also submitted that accused Nos. 1 and 2 were arrested and thereafter released on bail. Under such circumstances, there is no requirement for the custodial interrogation of the petitioner.
Accordingly, the petitioner is directed to surrender before the Investigating Officer within seven days from today for interrogation. After interrogation, he shall be released on bail on executing a bond for Rs.25,000/-(Rupees Twenty Five Thousand only) with two solvent sureties each for the like sum to the satisfaction of the Investigating Officer, on the following conditions:
i. The petitioner will remit an amount of Rs.30,000/-(Rupees Thirty Thousand Only) within seven days from the date of execution of the bond as stated above.
ii. The petitioner shall report before the Investigating Officer, as and when required by the Investigating Officer.
iii. The petitioner shall not induce, threaten or intimidate any person from disclosing facts known to them to the Investigating Officer or the court.
If any of the conditions are violated, the jurisdictional court concerned shall be empowered to take steps for cancellation of bail as per law.
