Heard Mr. Somik Deb, learned senior counsel assisted by Mrs. Riya Chakraborty, learned counsel appearing for the petitioners as well as Mr. P.K. Dhar, learned senior counsel assisted by Mr. K. De, learned Addl. G.A. appearing for the respondents.

The petitioners by way of filing the instant writ petition have challenged the selection process for the post of TPS, Grade-II. It is the contention of the petitioners that they being the "Subedars" are only eligible to be considered for promotion to the post of TPS Grade-II. It is their grievance that in the said selection process, the persons holding the post of Subedar(Accountant), Subedar(Head Clerk), Subedar(Signal Platoon) & Subedar (Medical Platoon) have been equated to the persons holding the posts of "Subedar" and further they are found eligible to be considered for promotion to the post of TPS, Grade-II. According to the petitioners, the recruitment rule only provides the post of "Subedar" as the feeder post of TPS Grade-II.

Without entering into the controversy of the subject in dispute, I direct the respondents to proceed with the selection process strictly in conformity with the recruitment rule framed under Article 309 as well as the relevant TSR Rules applicable to fill-up the post of TPS-Grade-II.

With the aforesaid order and directions, the instant writ petition stands disposed.
