Judgment
Heard Mr. K. Nath, learned counsel appearing for the petitioner.
By means of this writ petition, the petitioner has challenged the decision of rejecting his bid on the ground that a recognized temple falls within 100 meters of the proposed shop. According to the petitioner, the said ground is faulty as the recognized temple is far away, at least 150 meters away from the propose shop.
Be that as it may, issue notice calling upon the respondents to show cause as to why a Rule should not be issued as prayed for; and/or any other such further order(s) should not be passed as to this Court may deem fit and proper having regard to the circumstances of the case.
Notice is made returnable on 19.06.2020.
Since, Mr. D. Bhattacharya, learned G.A. appears and waives notice for the respondents No.1, 2 and 3, no formal notice be issued in respect of those respondents.
The petitioner shall serve the notice on the respondent No.4 by speed post with AD for which the necessary requisite be filed in the course by tomorrow. The petitioner is also permitted to serve the notice by Dasti on conforming the procedure for such service.
In the meanwhile, the status quo as on today shall be maintained.
Mr. Bhattacharya, learned G.A. shall produce the report of the Surveyor in respect of the distance between the said temple and the proposed shop. If the report is not available with the Collector of Excise, West Tripura, a team of Surveyors may survey and file the report to the Collector of Excise and the said report shall be placed before us on the next date.
