Judgment
Heard learned counsel for the parties. This Appeal has been filed against order dated 20.06.2023 passed by the Adjudicating Authority on the application I.A. No. 2564 of 2023 where direction was sought by the Respondent to certify the financial statement in prescribed forms for completion of the filing with the MCA and other authorities.
The Appellant challenging the order has come up in this Appeal and submits that Appellants have made various complaints regarding the financial affairs conducted by earlier management and Appellant has no objection in making certification provided the comments and observation of the Director on factual status may also be incorporated while making certification.
Learned counsel for the Respondent submitted that they have no objection if comments of the Director are incorporated while certifying the financial statement.
In view of the above, we see no need to entertain this Appeal. The Appeal is disposed of. It shall be open for the Appellant to give his comments within a week. With these observations, the Appeal is disposed of.
