The instant matter while being heard today, it is noted that inspite of service of notice upon the respondent Bank, there has been no appearance on their behalf. It is further noted that, an order as far back as on 05.12.2017, had been passed by the Debts Recovery Tribunal allowing the claim of the respondent Bank and orders for issuance of Recovery Certificate was issued.
On a query by this Court, the learned counsel for the petitioner fairly submits that he is unaware about the exact situation of the case presently, but submits that the matter is only on a very limited issue, which concerns the closing of the filing of written statement by the petitioner.
I have given my thoughtful consideration of the matter at hand, and on perusing the Cause Title, it appears that the address of the Bank is not addressed to any Bank functionary, but only to the office itself.
As such, in this view of the matter, it would be fit and proper for the ends of justice that, fresh steps be issued by personal service and registered A/D to be undertaken by the writ petitioner on the Branch Manager of the Respondent Bank in its branch as indicated in the Cause Title.
The same shall be completed within a period of 1 (one) week from today.
Accordingly, list this matter on 26th October, 2022.
