Judgment

Petitioners are accused Nos. 1 and 2 in C.C. No.6/2011 on the files of the Judicial First Class Magistrate Court-III, Thrissur. The offences alleged against the accused are under Sections 294(b) and 353 read with Section 34 of the Indian Penal Code, 1860.
Due to the non appearance of the petitioners, non bailable warrant has been issued against them. Even though petitioners are willing to appear and participate in the trial, they apprehend that they will be remanded to custody.
Having heard the learned counsel for the petitioners and the learned Public Prosecutor, I am of the view that this Crl.M.C. can be disposed of with a direction.
Accordingly, if the petitioners surrender before the jurisdictional court within 21 days from today, the learned Magistrate shall consider the applications for recall of warrant and for grant of bail, if any, filed by the petitioners in C.C. No.6/2011, preferably on the date of appearance itself.
To enable the petitioners to appear before the learned Magistrate as directed above, the non bailable warrant issued against the petitioners shall be kept in abeyance for a period of 21 days from today.
The Crl.M.C.is disposed of with the above direction.
