Judgment
Learned counsel Mr. Rajesh Parihar puts in appearance on behalf of respondent No.4. Notice upon respondent No.5 is still awaited.
We have gone through the writ petition, wherein the petitioner has raised grievance that in Ward No.17, towards public road at Subhash Nagar Road, Rajgarh, Tehsil Rajgarh, District Churu, some of the persons have made encroachments over the public passage / road and despite several attempts made by the petitioner and other residents, the respondents are not removing the illegal encroachments and on account of that the residents of Ward No.17 are facing great difficulties.
Having heard learned counsel for the petitioner and after going through the averments made in the petition, we deem it appropriate to dispose of this writ petition with liberty to the petitioner to move a fresh representation before the concerned respondent with a prayer for removing the illegal encroachment from the public passage / road.
If any such representation is moved by the petitioner within a period of two weeks, the concerned respondent shall consider and pass appropriate order in accordance with law after providing opportunity of hearing to all the persons concerned.
Ordered accordingly.
