Judgment
Dharam Veer, J.—Heard LP Naithani, Sr. Advocate assisted by Mr. BS Parihar, Advocate for the applicant and Mr. Amit Bhatt, Addl. GA for the State.
Learned Sr. Counsel for the applicant submitted that the applicant has qualified the Preliminary Examination of PCS, Uttar Pradesh and the Main Examination is scheduled to be held from 29.11.2010 to 18.12.2010. Copies of the admit card of the applicant and date sheet of the Main Examination have also been annexed with the present application.
Having heard the submissions of learned Counsel for the parties and considering the other facts and circumstances, the Court is of the view that the applicant deserves parole i.e. short term bail for five weeks..
Hence, the applicant Abhay Kumar Pandey is granted parole for five weeks with effect from 15.11.2010. He is directed to be released from jail if he furnishes a personal bond and two sureties each in the like amount to the satisfaction of CJM, Nainital. After completion of the aforesaid parole period, the applicant Abhay Kumar Pandey shall surrender himself before the CJM, Nainital on 20th December, 2010.
Short term bail application is disposed of accordingly.
