Heard the petitioner who is appearing in person and Mr. Mukesh Kumar, learned A.P.P. for the State.

In this application, the petitioner has prayed for quashing of the order dated 08.02.2017 passed in S. T. No. 265 of 2017 whereby and whereunder bail bond of the petitioner has been cancelled and non- bailable warrant of arrest has been ordered to be issued against her.

It has been stated by the petitioner that she was represented by the panel lawyer of the JHALSA, but without mentioning the said fact the bail bond of the petitioner has been cancelled. An undertaking has also been given that she shall appear on each and every date as and when directed by the learned trial court.

Leaned A.P.P. opposed the prayer.

It appears that the petitioner was directed to appear for hearing on the point of charge on 08.02.2017, but in absence of physical presence of the petitioner, the bail bond of the petitioner was cancelled and non-bailable warrant of arrest was directed to be issued against her.

In view of the submissions advanced by the petitioner wherein she has undertaken to appear on each and every date as and when directed by the learned trial court, this application is disposed of directing the petitioner to appear on the next date i.e., 02.03.2017 and if she appears on the said date, the impugned order dated 08.02.2017 shall be kept in abeyance. However, if the petitioner does not appear on 02.03.2017, the impugned order dated 08.02.2017 shall automatically revive.

This application is disposed of accordingly. Let a copy of this order be handed over to the petitioner.
