Abdul Rehman vs State of H.P. and Others

Kurian Joseph, C.J.—The petitioner and private respondent are Junior Engineers. The petitioner is aggrieved since he is transferred from Ghumarwin to Bilaspur. According to the petitioner, he has been residing at Ghumarwin since around 11/2 years. The private respondent, however points out that the petitioner actually belongs to Bilaspur and petitioner does not hold the charge of Ghumarwin section but Bhager Section. It is around five kilometer from Ghumarwin. As far as private respondent is concerned, his children are studying at Ghumarwin and hence he got transferred to Ghumarwin. It is also informed that private respondent joined duties at Ghumarwin on 1.6.2010. Therefore, this writ petition is disposed of as follows:

The petitioner may file an appropriate representation before second respondent in case he is still aggrieved by his transfer from Bilaspur, pointing out the place of his choice in the same place, subject to the availability of vacancy. In that event the representation will be considered by the second respondent". Interim order dated 4.6.2010 shall stand vacated.
