In the instant writ petition, petitioner is seeking direction against the respondent-Sub Registrar Ganderbal to pass an order for registration of sale deed of petitioner for land measuring 05 marlas falling under Khasra No. 155 min, Khewat No.147 and Khata no. 321 situated at mouza Malshahi Bagh Tehsil and District Ganderbal in accordance with law. The petitioner has also sought direction upon the respondent-inspector General Registration J&K, Srinagar, to constitute a team to conduct a full dressed enquiry with respect to the registrations/ refusal of documents of registration by Sub Registrar Ganderbal w.e.f January 2022 till date.
Counsel for the petitioner submits that he would be satisfied if respondent-Sub Registrar Ganderbal is directed to pass a fresh order for registration of sale deed of petitioner for land measuring 05 marlas falling under Khasra No. 155 min, Khewat No.147 and Khata no. 321 situated at mouza Malshahi Bagh Tehsil and District Ganderbal in accordance with law and further the Inspector General Registration J&K, Srinagar be directed to conduct a full dressed enquiry with respect to the registrations/ refusal of documents of registration by Sub Registrar Ganderbal w.e.f January 2022 till date.
Be that as it may, the instant writ petition is disposed of with a direction to the registration authority to pass appropriate orders as available under law while taking into consideration the documents in question within a period of two weeks and in case of refusal of documents of registration then a detailed speaking order in accordance with law be passed from the date copy of this order is served upon respondents.
