Judgment
A.S. Pachhapure, J.—These petitions are filed by accused Nos. 2 and 8 in Crime No. 73/2010 registered for the offence punishable u/s 120(B) of IPC and also under Sections 3, 5, 25 and 27 of the Indian Arms Act.
It has been submitted before this Court that accused Nos. 2, 4, 5 and 6 are granted bail by Session Court and this Court granted bail for accused Nos. 9, 10 and II
There is an allegation of conspiracy to eliminate on. Harish Rai and that accused were holding revolver.
Since the other accused against whom similar allegations were made have been granted bail, these Petitioners are also entitled to bail on the principle of parity.
In the circumstances, the Petitioners are ordered to be released on bail, subject to the following conditions.
1) Petitioners each shall execute bonds for sum of Rs. 50.000/- and offer a surety far the like sum each to the satisfaction of jurisdictional court.
2) Petitioners shall not intimidate or tamper with the prosecution witnesses.
3) Petitioners shall regularly amend the court.
4) Petitioners shall mark their attendance between 11.00 am and 2.00 pm on every Sunday with the jurisdiction police, until further orders.
