Judgment
Heard.
The learned Government Advocate appearing for the Respondent nos. 1, 3 and 4, states that the Petitioners would have to raise a dispute under Section 83 of the Goa Co-operative Societies Act, 2001 and Rules 2003, considering that the Returning Officer-Respondent no.3, has passed an order, after scrutinising the nomination papers. He states that the copy of the said order will be furnished to the Petitioners within 48 hours. Statement accepted.
Learned Additional Government Advocate further submits that it is open for the Petitioners to approach the Registrar-Co-operative Society and raise the very same grievances raised in this Petition, before the said authority. He submits that if the Petitioners make a representation, the concerned Registrar will take an appropriate decision on the said representation. Statement accepted.
If a representation is made by the Petitioners before the Registrar-Co-operative Society today during the course of the day, the concerned Registrar to decide the said representation within 48 hours of the presentation of the said representation.
In view of the aforesaid, nothing survives for further consideration in this Petition. Accordingly, the Writ Petition stands disposed of.
It is made clear that we have not gone into the merits of the Petition and, as such, all contentions of all parties are kept open.
All parties to act on the basis of an authenticated copy of this order.
