The revision petition is filed challenging the order passed in CMP No.3297/2014 in CC No.356/2009 of the Court of the Judicial First Class Magistrate-I, Sulthan Bathery, dismissing the application filed by the revision petitioner to discharge him of the offences alleged in the above case.
Heard; Sri.Nirmal.V.Nair, the learned counsel appearing for the revision petitioner and the learned Public Prosecutor appearing for the respondents.
Today when the revision petition was taken up for consideration, the learned counsel appearing for the revision petitioner submitted that the revision petition has become infructuous because subsequent to the impugned order, as no interim order was passed by this Court, the revision petitioner has been acquitted in the above case. Therefore, the revision petitioner is no longer desirous of prosecuting the revision petition. The said submission is recorded.
In the light of the above submission, I hold that the revision petition has become infructuous.
Resultantly, the revision petition is dismissed as withdrawn.
